Mythology Labs, LLP (“ML”, “us”, “we”, or “our”) operates the www.writaa.com website and the Writaa mobile applications (collectively referred to as “Writaa” OR the “Service”).

At Writaa, we collect and manage data according to Privacy Policy below.

This policy outlines our practices regarding the collection, use and disclosure of Personal Information when you use our Service.

We will not use or share your information with anyone except as described in this Privacy Policy.

We use your Personal Information for providing and improving the Service. By using the Service, you agree to the collection and use of information in accordance with this policy.

TL;DR

  • Writaa does not own your data or claim any rights to it. We never sell data to others or use it for advertising. Your data is yours.
  • You can change or delete your data at any time.
  • We never share any information about your projects, sessions or activity on the Writaa website or app with anyone unless you explicitly allow us to.
  • To improve our service, we share some statistical data and some personal information with third parties.
  • You’re welcome to use content blocking software (e.g. to remove analytics tags); however be aware that this may interfere with our ability to track errors and performance issues that affect your account.
  • We encrypt backups, don’t store credit card numbers on our servers and always try to make sure your data is safe.
  • When legally required, or when we suspect fraud, we may share data with law enforcement.
  • If you have questions, or want to export or delete your data, please write to support@writaa.com.

Data We Collect

We collect anonymous data from every visitor of the Website or when you access the Service by or through a mobile device (“Log Data”). We use this Log Data to monitor traffic and fix bugs.

For your computer, this Log Data may include information like web requests, the data sent in response to such requests, the Internet Protocol (“IP”) address, the browser type, the browser language, a timestamp for the request, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages and other statistics.

When you access the Service by or through a mobile device, this Log Data may include information such as the type of mobile device you use, your mobile device unique ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browser you use and other statistics.

For using the Service, we ask you to register an account, log in and provide certain personally identifiable information that can be used to contact or identify you. Such information may include but is not limited to your email address, name, other information (“Personal Information”).

We use cookies to store session information for your convenience. Cookies must be enabled to use the Service. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. The Help feature on most browsers provide information on how to accept cookies, disable cookies or to notify you when receiving a new cookie. If you do not accept cookies, you may not be able to use some features of our Service and we recommend that you leave them turned on.

We collect this information for the purpose of providing the Service, identifying and communicating with you, responding to your requests/inquiries and improving our services.

In order to take advantage of certain features of the Service, you may also choose to provide us with other personal information, such as your picture, but your decision to use these features and provide such data is voluntary.

Use of Data

We use your personal information to provide you with the Service to communicate with you about the Service or the Website. Your data may be processed to improve the Service, which includes both automated and manual processing of data.

With respect to any data you may choose to enter or upload to the Service, we take the privacy and confidentiality of this data seriously. Your data (in the Service) is specifically not shared between accounts or with the public. We employ industry standard techniques to protect against unauthorized access of data that we store, including personal information. All off-site backups of your data are securely encrypted.

Please note that if you choose to share data (like sharing your Writaa Projects with others), we are not responsible for any violation of privacy law you may be liable for.

We do not share personal information you have provided to us without your consent, unless:

  • doing so is appropriate to assist a user with their support request;
  • we believe it’s necessary in order to provide the highest quality of service;
  • we believe it’s needed to enforce our Terms of Service, or that it is legally required;
  • we believe it’s needed to detect, prevent or address fraud, security or technical issues;
  • otherwise protect our property, legal rights, or that of others.

Irrespective of the location where you use our website or apps from, you agree to any processing of any personal information you provide us according to this policy.

Writaa may contact you by email. For example, Writaa may send you promotional emails relating to Writaa or communicate with you about use of the Writaa Website and Service. If you do not want to receive email from Writaa, please opt out of receiving emails at the bottom of any Writaa email. Please note that for some emails (for example customer support emails), there’s no option to opt-out.

Data Sharing

We don’t share your personal information with third parties except as listed below. Other than the information outlined below, only aggregated, statistical data is periodically transmitted to external services to help us improve the Service.

For client-side analytics and tracking beacons, you’re welcome to use content blocking software. Be aware that using these software may influence our ability to identify errors and performance problems in your account. We can’t guarantee that Writaa will work as intended since these software alter the HTML, CSS or JavaScript code we transmit. Writaa doesn’t take any active steps to prevent you from using extensions, including content blockers.

We currently use third party services including Amazon Web Services and Google Analytics that collect, monitor and analyze data and personal information in order to increase our Service’s functionality. These third party service providers have their own privacy policies addressing how they use such information.

Other analytics tools we use include Helpscout for in-app customer support, and, Google Analytics for search engine analytics.

Additionally, Writaa uses third party vendors that provide the necessary hardware, software, networking, storage and other technology required to run the the Service. While ML owns the rights to the Writaa Service, you retain all rights to the data you enter into Writaa.

In order to provide the Service, we also share data with services that help us track of errors and bugs, keep backups, store log files and identify performance issues.

We employ and contract with people and other entities that perform certain tasks on our behalf and who are under our control (our “Agents”). We may need to share personal information with our Agents in order to provide products or services to you. Unless we tell you differently, our Agents do not have any right to use Personal Information or other information we share with them beyond what is necessary to assist us. You hereby consent to our sharing of Personal Information with our Agents.

If Writaa is acquired or merged with an other company, or if Mythology Labs LLP goes out of business or enters bankruptcy, user information may be transferred to a third party. You acknowledge that such transfers may occur, and that any acquirer of Writaa or its assets may continue to use your personal information as set forth in this policy.

Service Providers & Subprocessors

  • We may employ third party companies and individuals to facilitate our Service (“Service Providers”), to provide the Service on our behalf, to perform Service-related services or to assist us in analyzing how our Service is used.
  • These third parties have access to your Personal Data only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.

Analytics

We may use third-party Service Providers to monitor and analyze the use of our Service.

  • Google Analytics: Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of our Service. This data is shared with other Google services. Google may use the collected data to contextualize and personalize the ads of its own advertising network. You can opt-out of having made your activity on the Service available to Google Analytics by installing the Google Analytics opt-out browser add-on. The add-on prevents the Google Analytics JavaScript (ga.js, analytics.js, and dc.js) from sharing information with Google Analytics about visits activity. Behavioral Remarketing

Writaa uses remarketing services to advertise on third party websites to you after you visited our Service. We and our third-party vendors use cookies to inform, optimize and serve ads based on your past visits to our Service.

  • Google AdWords: Google AdWords remarketing service is provided by Google Inc. You can opt-out of Google Analytics for Display Advertising and customize the Google Display Network ads by visiting the Google Ads Settings page:http://www.google.com/settings/ads. Google also recommends installing the Google Analytics Opt-out Browser Add-on -https://tools.google.com/dlpage/gaoptout – for your web browser. Data Retention and Deletion Schedules

  • Backups are securely encrypted and stored as defined in our Privacy Policy. In order to accommodate customers who need older data restored, we keep backups indefinitely and cannot delete personal data from them as these are stored off-site as read-only and heavily encrypted, in a compressed state.
  • We keep copies of all purchasing records for tax and auditing purposes.
  • We keep personal metadata, given that the user allows us to process their data, which can be controlled by going the Settings page in your Writaa account.
  • Some 3rd party services collect data independently from us, and have incorporated it as part of their service. We do not store any copies of this data, and Data Subject Requests for this data must be submitted to the 3rd party service, since we do not control the data.
  • We keep all internal business data as long as it’s relevant, and internal business data may include the data listed above.

Children’s Privacy

Our Service does not address anyone under the age of 18 (“Children”).

We do not knowingly collect personally identifiable information from anyone under the age of 18. If you are a parent or guardian and you are aware that your Children have provided us with Personal Data, please contact us. If we become aware that we have collected Personal Data from children without verification of parental consent, we take steps to remove that information from our servers.

Compliance With Laws

We will disclose your Personal Information where required to do so by law or subpoena or if we believe that such action is necessary to comply with the law and the reasonable requests of law enforcement or to protect the security or integrity of our Service.

Security of your Personal Data and Content

The security of your Personal Information and Data you save in Writaa is important to us, and we strive to implement and maintain reasonable, commercially acceptable security procedures and practices appropriate to the nature of the information we store, in order to protect it from unauthorized access, destruction, use, modification, or disclosure.

However, please be aware that no method of transmission over the internet, or method of electronic storage is 100% secure and we are unable to guarantee the absolute security of the Personal Information or Data we have collected from you.

Consent for International Data Transfer

Your information, including Personal Information, may be transferred to — and maintained on — computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from your jurisdiction. If you choose to provide information to us, please note that we transfer the information, including Personal Information, to computers and servers to multiple locations around the world and process it there.

Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

GDPR Data Processing Agreement

If you are a resident of the European Economic Area (EEA), you have certain data protection rights. Writaa aims to take reasonable steps to allow you to correct, amend, delete, or limit the use of your Personal Data.

If you wish to be informed what Personal Data we hold about you and if you want it to be removed from our systems, please contact us at support@writaa.com.

In certain circumstances, you have the following data protection rights:

  • The right to access, update or to delete the information we have on you. Whenever made possible, you can access, update or request deletion of your Personal Data directly within your account settings section. If you are unable to perform these actions yourself, please contact us to assist you.
  • The right of rectification. You have the right to have your information rectified if that information is inaccurate or incomplete.
  • The right of restriction. You have the right to request that we restrict the processing of your personal information.
  • Thr right to object. You can object to the processing of your personal information, ask us to restrict the processing of your personal information, or request portability of your personal information. You can exercise these rights by emailing support@writaa.com.
  • The right to withdraw consent. Similarly, if we have collected and process your personal information with your consent, then you can withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.
  • You have the right to opt-out of marketing communications we send you at any time. You can exercise this right by clicking on the “unsubscribe” or “opt-out” link in the marketing emails we send you. To opt-out of other forms of marketing, please contact us by emailing support@writaa.com.
  • The right to data portability. You have the right to be provided with a copy of the information we have on you in a structured, machine-readable and commonly used format.
  • You have the right to complain to a data protection authority about our collection and use of your personal information. For more information, please contact your local data protection authority.

EU-U.S. and Swiss-U.S. Privacy Shield Frameworks

Writaa complies with the EU-U.S. Privacy Shield Framework and Swiss-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union and Switzerland to the United States. Mythology Labs LLP has certified to the Department of Commerce that it adheres to the Privacy Shield Principles. If there is any conflict between the terms in this privacy policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. Writaa is responsible for the processing of personal data it receives, under each Privacy Shield Framework, and subsequently transfers to a third party acting as an agent on its behalf. Writaa complies with the Privacy Shield Principles for all onward transfers of personal data from the EU and Switzerland, including the onward transfer liability provisions.

With respect to personal data received or transferred pursuant to the Privacy Shield Frameworks, Writaa is subject to the regulatory enforcement powers of the U.S. Federal Trade Commission. In certain situations, Writaa may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

Within the scope of our authorization to do so, and in accordance with our commitments under the Privacy Shield, Writaa will provide individuals access to personal data about them. Writaa also will take reasonable steps to enable individuals to correct, amend, or delete personal data that is demonstrated to be inaccurate.

In compliance with the Privacy Shield Principles, Writaa commits to resolve complaints about our collection or use of your personal information. EU and Swiss individuals with inquiries or complaints regarding our Privacy Shield policy should first contact Writaa at:

Writaa has committed to refer unresolved Privacy Shield complaints to an alternative dispute resolution provider located in the United States. If you do not receive timely acknowledgment of your complaint from us or are not satisfied with our response, please contact JAMS at https://www.jamsadr.com/file-an-eu-us-privacy-shield-or-safe-harbor-claim. JAMS is the US-based independent organization responsible for reviewing and resolving complaints about our Privacy Shield compliance — free of charge to you. To facilitate fast and convenient resolution of complaints, you agree to participate in on-line dispute resolution through JAMS Online Mediation.
In the event your concern still isn’t addressed by JAMS, you may be entitled to a binding arbitration under Privacy Shield and its principles.

Changes To This Privacy Policy

We reserve the right to update or change our Privacy Policy at any time and you should check this Privacy Policy periodically at writaa.com/docs#privacy. If we make any significant changes to this Privacy Policy, we will notify you either through the email address you have provided us, or by placing a prominent notice on our website. Your continued use of the Service after we post any modifications to the Privacy Policy on this page will constitute your acknowledgment of the modifications and your consent to abide and be bound by the modified Privacy Policy.
